Care Evidence, Quantum and Loss of Services

Posted by Dilara Rogers

Care evidence often sits at the centre of serious injury and clinical negligence claims. It affects quantum, rehabilitation planning, family support, equipment, adaptations, paid care, unpaid care and loss of services.

This clinical training session is designed to help solicitors and legal teams understand how care needs are assessed, how occupational therapy evidence can support the legal picture, and how care recommendations may be translated into practical evidence for a claim.

Delivered by: Joanne Lowe, Occupational Therapy Expert Witness and Expert Witness Services Lead

What the session covers

The session provides a practical overview of how care needs are identified and evidenced. It considers the role of occupational therapy in understanding daily function, the impact of injury or disability on ordinary activities, and the support that may be needed at home, in the community and over time.

It can also explore the distinction between paid and unpaid care, the evidential issues that arise around family support, and the way domestic tasks and loss of services may need to be considered within the wider quantum evidence.

  • Care needs assessment
  • Activities of daily living
  • Paid and unpaid care
  • Domestic support and household tasks
  • Equipment and adaptations
  • Care calculations
  • Loss of services evidence
  • Common issues in quantum reports
  • How occupational therapy evidence supports care and rehabilitation claims

Why this matters for solicitors

Care evidence is rarely just a list of tasks. It requires careful consideration of what the person can do, what they cannot do safely or consistently, what support is already being provided, and what may be required in the future.

For solicitors, understanding the clinical reasoning behind care recommendations can support better instructions, clearer questions for experts and a more informed approach to quantum evidence.
